The petitioner was granted bail by a Coordinate Bench by an order dated September 1, 2023, inter alia, on the conditions that he shall remain within the municipal limits of the districts of North 24 Parganas and Kolkata and shall report to the Superintendent, Narcotics Control Bureau (NCB) once in a month until further orders. Further, the petitioner shall deposit his passport before the learned Trial Court prior to his release. 2.

The petitioner has now approached us for relaxation of the aforesaid three conditions of bail. He says that he is a businessman and the aforesaid conditions are causing great hardship to his occupation. He has adhered to the conditions of bail. He shall attend each and every date of hearing before the learned Trial Court.

NCB has filed a report wherein we do not find anything adverse as against this petitioner. The petitioner seems to have been complying with the conditions of bail. 4.

In view of the aforesaid, we are inclined to allow the petitioner to travel beyond the municipal limits of the districts of North 24 Parganas and Kolkata and we, accordingly, allow him to do so. He also need not report to the Superintendent, NCB once every month. However, if and when called for, he shall report to the concerned officer.

Insofar as the prayer for return of his passport is concerned, we are not inclined to allow the same. However, as and when the necessity arises, the petitioner will be at liberty to make this prayer before the learned Trial Court who shall consider and decide the same in accordance with law.

The order of bail is modified to the aforesaid extent. 7.

The other conditions of bail remain unaltered. 8.

CRAN 1 of 2024 is, accordingly, disposed of.
