Heard learned advocates appearing for the parties. It appears from Annexure P-4 at page 109 of the wit petition that petitioner has made a representation on 15th July, 2022 before the respondent authorities concerned for redressal of its grievance and it is the allegation of the petitioner that the respondents concerned are sitting over the said representation and till date, the same has not been disposed of. Petitioner, in support of his contention, relies on a decision of this Court in the case of Kinaram Vintrade Pvt. Ltd. Vs. State of West Bengal reported in 2022 (65) GSTL 163 (Cal.).

Considering the facts and circumstances of this case and submission of the parties and particularly the submission of Mr. Kundalia, learned advocate representing the respondent CGST authority that little time may be

granted to dispose of the said representation, this writ petition being WPA 20867 of 2022 is disposed of by directing the respondent authorities concerned to consider and dispose of the aforesaid representation of the petitioner dated 15th July, 2022 in accordance with law and by passing a reasoned and speaking order and also by taking into consideration the aforesaid judgment of this Court upon which petitioner has relied on, within three weeks from the date of communication of this order. Needless to mention that before passing any final order by the respondent authority on the aforesaid representation, petitioner or his authorized representatives shall be given opportunity of hearing. It is expected that till the aforesaid representation is disposed of, the authority concerned shall not take any further coercive action against the petitioner.

With this observation and direction, this writ petition being WPA 20867 of 2022 is disposed of. (Md. Nizamuddin, J.)
