Affidavit-of-service filed on behalf of the petitioner is taken on record.

Petitioner is an unmarried daughter whose father retired on superannuation on 1st January, 1982. Father was in receipt of pension who died on 7th July, 2006. Mother of the petitioner predeceased father. Petitioner prays for sanction of family pension.

Learned advocate representing the State respondents submits that income certificate dated 6th August, 2025 though was issued by the competent authority but legal heir certificate till date has not been submitted before the concerned District Inspector of Schools (SE), Uttar Dinajpur being respondent no.3 for taking decision.

Learned advocate representing the petitioner submits that till date legal heir certificate has not been obtained.

Petitioner shall be at leave to obtain legal heir certificate from the competent authority. Application along with legal heir certificate and income certificate and other necessary documents shall be submitted before the respondent no.3 seeking sanction of family pension.

If application along with supporting documents are submitted before the respondent no.3, this Court expects that respondent no.3 shall take decision in accordance with law, within a reasonable time. 7.
The writ petition stands disposed of.

However, there shall be no order as to costs. 9.
Urgent photostat certified copy of this order, if applied for, be given to the learned Advocates for the parties on the usual undertakings.
