Although the facts are hazy in this case but the petitioners complain that they have been thrown out from the residence. Petitioner has already approached the Sub-Divisional Officer, Contai under the relevant provisions of the Maintenance and Welfare of Parents and Senior Citizens Act, 2007 for cancellation of the deed of gifts as well as for granting protection in respect of residing at the house without any coercion.

Learned advocate for the State has submitted that he has instructions that date of the proceedings has been fixed on 23.09.2025.

Learned advocate for the private respondents submits that several cases are pending under the relevant provisions of Indian Penal Code, PWDV Act, 2005 as well as proceedings under the relevant provisions of Maintenance.

Considering that an application is pending before the Sub-Divisional Officer, I am of the opinion that petitioner has already approached for exhausting the statutory remedies available. Having considered that the statutory provisions have been invoked by the petitioners and a date has been fixed, the learned Sub-Divisional Officer would expeditely dispose of the proceedings pending before him after hearing all the parties.

With the aforesaid observations WPA 20672 of 2025 is disposed of.
