The petitioner claims to be a physically challenged son of a deceased primary school teacher. He seeks family pension in terms of the Memorandum of the O.S.D. & Ex-Officio Joint Secretary, Government of West Bengal, School Education Department, Budget Branch, being No.10SE(B)/O/1M-131/2008 (Part-1) dated 13th January, 2009.

Learned advocate for the petitioner asserts that the application seeking family pension was served in the office of the respondent authorities, but there is no proof of service of the said representation before the authorities.

In view of the above, leave is granted to the petitioner to submit his representation seeking family

pension in the office of the District Inspector of Schools (Primary Education), Purba Medinipur. In the event such representation is made, the same shall be considered by the aforesaid respondent in accordance with law at the earliest but positively within a period of twelve weeks from the date of communication of this order.

If the petitioner is found entitled to receive family pension, steps shall be taken to disburse the same within the shortest possible time.

The writ petition stands disposed of.

Urgent photostat certified copy of this order be supplied to the parties, if applied for, as early as possible.
