In Re: CRAN 1 of 2023 The present application has been taken out for passing appropriate orders in view of the certain data being wrongly furnished before this Court on the earlier occasion. Mr. Basu, learned advocate appearing on behalf of the applicant/petitioner submits because of deficiency in documents it was submitted before this Court that there were seven witnesses but instead of the same, it has been found after the complete charge-sheet was available that there are 23 witnesses. In view of the aforesaid, it is not possible for the court of law to complete the prosecution evidence or pronounce judgment by 30th June, 2024. As such, the order dated 28.08.2023 is modified to the extent so far as the time period is concerned, the learned trial court would take efforts so that the prosecution evidence is completed by February, 2025. Thereafter, the learned trial court

would complete the examination under Section 313 of the Code of Criminal Procedure by 15th April, 2025. Defence be granted time to adduce evidence, if any, by 15th August, 2025. The learned trial court would thereafter commence the arguments of the case and try to conclude the arguments by 30th September, 2025. All efforts be made by the learned trial court to pronounce the judgment by 1st December, 2025. The aforesaid dates are tentative and the same will not prevent the learned trial court if the learned trial court is of the opinion that at any stage the learned trial court would have to exercise its option under Section 311 of the Code of Criminal Procedure.

With the aforesaid observations, CRAN 1 of 2023 is allowed.

This may be treated as an order which modifies the dates referred to in the order dated 28.08.2023.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
