And In re: Rajjak Seikh - Versus- State of West Bengal & Ors Mr. Debashis Banerjee, Mr. Rishav Kumar Singh For the petitioner Mr. Rana Mukherjee, Mr. Sabir Ahmed For the State Mr. Swapan Kumar Nandy For the Respondent nos.4 & 5 Mr. Banerjee, learned advocate appearing for the petitioner submits that on 3rd August, 2018 at about 7.00 p.m. the petitioner's father left his home for work but did not return back. Subsequent thereto, he came to learn that his father and two other persons had been shot down by the Border Security Force personnel of Outpost No.8, Harudanga Camp, Battalion-117. A complaint, thereafter, lodged by the petitioner was registered as Raninagar Police Station case No.487 of 2018 dated 29th September, 2018 under Sections 363/365 of the Indian Penal Code. However, subsequent thereto, the police authorities did not take appropriate steps in spite of several reminders. Aggrieved thereby, the petitioner approached this Court.
Mr. Mukherjee, learned advocate appearing for the State submits that on the basis of the petitioner's complaint Raninagar Police Station case No.487 of 2018 dated 29th September, 2018 was registered. Investigation was, thereafter, conducted and ultimately final report was submitted being Ranitala P.S. FRT No.128/20 dated 29th February, 2020.
Heard learned advocates appearing for the respective parties and considered the materials on record. The petitioner's complaint was registered as FIR and upon investigation, the final report has been filed. This is not a case of illegal detention.
In the said conspectus, no interference is called for in the present writ petition. However, the petitioner would be at liberty to take appropriate steps before the competent forum, if so advised and in accordance with law. Accordingly, the writ petition being WPA 19785 of 2018 is disposed of.
