Learned advocate appearing for the petitioner submits that there was recovery of 2000 bottles of phensedyl from two vehicles and similarly placed accused person has been granted bail in CRM (NDPS) 520 of 2025. It has also been pointed out that the Hon'ble Court while considering the bail of the coaccused took into account the evidence of PW3, PW8 and PW9 who were the members of the raiding team. The Court considered the involvement of the petitioner, such order was passed on 09.10.2025.

Learned advocate for the State on the other hand submits that 24 witnesses have already been examined and only 3 other witness are to be examined.

Having regard to the same, State is directed to conclude the prosecution evidence by 31st of March, 2026. Having considered the belated stage at which the petitioner has approached this Court, I am not inclined to release the petitioner on bail.

Accordingly, CRM (NDPS 1089 of 2025 is dismissed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
