Petitioner is aggrieved by the police excess being inflicted upon him and as such, informed the local police station, but in spite of informing the police station on or about 27.08.2025, no steps have been taken.

I have considered the police report dated 01.09.2025. The main grievance of the petitioner is against certain police officers who were working in discharge of their official duties, but petitioner complains of harassment, infliction of torture as also unlawful detention.

Having regard to the fact that the allegations are made against police personnel, I am of the view that special provisions have been incorporated under Section 175(4) of BNSS. Consequently petitioner would be at liberty to approach the jurisdictional Magistrate who would adhere to the provisions of law and thereby assess and ascertain regarding the genuinity of the accusations, consequently passing necessary orders as he deems fit and proper.

With the aforesaid observations, the writ petition being WPA 20445 of 2025 is disposed of. There will be no order as to costs.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
