The State of West Bengal Mr. Sumanta Das ...for the petitioners In this application, the petitioner has prayed for expeditious disposal of G.R. Case No.3012 of 2021 presently pending before learned Chief Judicial Magistrate, Krishnagar. Being aggrieved by the inordinate delay caused in disposal of the said proceeding, learned Counsel for the petitioner submits that FIR under Section 498A/34 was initiated against the accused person/petitioner on 20th March, 2019. The charge-sheet was submitted against the petitioner on 12th June, 2019. The charge under Section 498A of the IPC was framed against the accused on 21st September, 2024. Since then the matter is pending for recording evidence on behalf of the prosecution.

Prosecution proposes to examine 8 witnesses but they have not yet brought any of the witnesses and the proceeding is being dragged day after day. Accordingly, he prayed for necessary direction upon the Court below for expeditious disposal of the said proceeding.

party will have no cause to prejudice and, as such, the service of copy of application upon the opposite party is dispensed with. Having considered the fact that the case is pending for recording evidence after framing charge for about 2 years without recording evidence of a single witness, I find that the prayer made by the petitioner is justified and required to be allowed to secure the ends of justice.

In view of above, CRR 3859 of 2025 is hereby disposed of with a direction upon the Court below to make every endeavour for expeditious disposal of the proceeding being G.R. Case No.3012 of 2021 and to make its best effort to conclude the entire proceeding preferably within a period of six months from the next date of hearing.

This order is passed invoking this Court's jurisdiction under Section 529 of the BNSS.
