Mr. Anindya Sundar Das Mr. Shounak Ghosh Ms. Suva Gayan Mr. Suman Halder ... for the Petitioner(s) Mr. Tapan Coomer Dey Ms. Sayani Das ... for the State-Respondent(s) The petitioner complains that inspite of Khanakul PS Case No. 593 of 2025 dated 25.08.2025 being registered for investigation, severe inconveniences are faced by him - although, he happens to be an Advocate by profession and has been suffering consequences because of the services rendered by him to his client.

The petitioner further complains that although Khanakul P.S. registered FIR but the petitioner and his family members who are residing at Khanakul are also facing threats and severe inconveniences.

State has submitted a report which reflects that notices have been sent under Section 35(3) of the BNSS.

It has also been stated in the report that the FIR named accused persons have been released on bail.

Having considered the submissions advanced, I am of the opinion that the petitioner will approach the court in seisin of the issues. If the petitioner further complains that his life and liberty as also his family members' are jeopardized, he would prefer an application before the learned Magistrate. The learned Magistrate would assess, analyze and decide whether the private respondents/accused persons have taken the law in their own hands and, thereafter, would pass order(s) independently without being influenced by any of the observations made herein above.

The police authorities are directed

to ensure that there is no breach of any peace and tranquility and, to that effect, they would keep a strict vigil in the area complained of.

With the aforesaid observations, WPA 20693 of 2025 disposed of.

Pending application(s), if any, is also disposed of.

Report so submitted be kept with the record.

Supplementary Affidavit filed be also kept with the record.
