Jiban Chandra Das Mr. Anirban Sah Roy ....for the petitioner This application under Article of the Constitution of India is at the instance of the plaintiff praying for a direction upon the learned Civil Judge (Jr. Div.), 5th Court at Alipore to dispose of the Title Suit No.1350 of 2023 expeditiously.

The learned advocate appearing for the petitioner submits that repeated dates have been fixed for payment of cost and for acceptance of written statement. In view of the order sought and proposed to be passed this Court feels that there is no necessity to direct issuance of any notice upon the opposite party. However, the learned advocate for the petitioner shall be obliged to forward a copy of this application along with this order upon the opposite party or his learned advocates representing the opposite party before the learned trial judge.

From the order sheets appended to this application, this Court finds that September 10, 2025 has been fixed for payment of cost and for framing of issues.

In view thereof, CO 3231 of 2025 stands disposed of by requesting the learned Civil Judge (Jr. Div.), 5th Court at Alipore to take up the issue with regard to payment of cost and acceptance of written statement on the next date and to proceed thereafter in accordance with law.

There will be no order as to costs.
