Vs.
The State of West Bengal & Anr.
Mr. Amitabha Ghosh, Advocate Mr. Madan Mohan Roy, Advocate Mr. Haripada Nayak, Advocate ......for the Petitioners Mr. Saswata Gopal Mukherjee, Ld. Public Prosecutor Mr. Imran Ali, Advocate Ms. Debjani Sahu, Advocate ......for the State 1.
The instant revision application has been filed with a prayer for quashing the charge-sheet in connection with Serampore Police Station Case No. 504 of 2015 dated 02.11.2015 (G.R. Case No. 2044 of 205) under Sections 498A/406 of the Indian Penal Code read with Sections 3/ 4 of the Dowry Prohibition Act 2.
It appears from the record that the revisional application was filed in the year 2017 with a prayer for quashing the charge-sheet.
3.
It is submitted on behalf of the petitioners that charges have been framed after hearing both sides and liberty may be given to the petitioners to raise all these issues before the Trial Court.
4.
Considering the prayer of the petitioners under Section 482 of the Code of Criminal Procedure, I am unable to quash the charge-sheet on which the Trial Court has already framed charges after hearing both sides. 5.
In view of the aforesaid view of the matter, the instant revisional application being CRR 2775 of 2017 stands disposed of with liberty to the petitioners to agitate all the issues before the Trial Court during trial.
6.
Interim order, if there be any, stands vacated. 7.
Connected applications, if there by any, shall also stand disposed of.
8.
Considering the long pendency of this case, the Trial Court is requested to dispose of the case as expeditiously as possible.
9.
Both sides are directed to act on the server copy of this order available from the official website of this Court. (Bibhas Ranjan De, J)
