1. Affidavit-of-service filed by the petitioner is retained with the records.

2. The prayer of the petitioner for shifting of the electric pole has been allowed by the Superintending Engineer and Regional Manager of WBSEDCL, Purba Medinipur, Regional Office subject to scope of shifting and cost of shifting being borne by the petitioner.

3. The petitioner alleges that till date the scope of shifting has not been ascertained and the cost of shifting not assessed.

4. The competent authority of the licensee is directed to ascertain the scope and feasibility of shifting of the electric pole and if the same is feasible, the cost for shifting be assessed and intimated to the petitioner.

5. It has been submitted that the petitioner belongs to 'below poverty level' category and he may not be in a

position to bear the cost of shifting of the electric pole.

6. The authority shall keep in mind the financial status of the petitioner at the time of consideration of the feasibility of shifting the electric pole.

7. Steps shall be taken at the earliest but positively within a period of twelve weeks from the date of communication of this order.

8. The writ petition stands disposed of.

9. Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
