The petitioner's prayer seeking transfer of allotment in respect of Flat No. D, 2/5 at Ultadanga Housing Complex constructed by the Calcutta Improvement Trust is pending consideration.

Without entering into the merit of the representation filed by the petitioner, the instant writ petition is disposed of by directing the respondent no. 2 being the Deputy Secretary, KMDA (KIT Wing) to consider the representation filed on behalf of the petitioner in accordance with law after giving

reasonable opportunity of hearing to all the necessary parties at the earliest but positively within a period of eight weeks from the date of communication of this order.

The aforesaid respondent shall pass a reasoned order and communicate the same to the parties immediately thereafter.

It is made clear that this Court has not entered into the merit of the claim made by the petitioner and all points are left open to be decided by the aforesaid respondent at the time of consideration of the representation of the petitioner.

Learned counsel appearing for the petitioner is directed to forward a copy of the representation dated 7th August, 2022 to the aforesaid respondent at the time of communicating the order of this Court. The writ petition stands disposed of.

Urgent photostat certified copy of this order, if applied for, be given to the parties on usual undertakings.
