Rakib (rejected) CRM (NDPS) 1097 of 2025 In Re: An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/Under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Kaliganj Police Station case no. 1095 of 2024 dated 14.12.2024 under Sections 21(b)(ii)(c)/25/29 of the Narcotic Drugs and Psychotropic Substances Act, 1985.

Learned advocate appearing for the petitioner submits that the petitioner is innocent of the charges and has been falsely implicated in connection with the instant case on the alleged recovery of 90 kgs 270 grams of ganja from a truck. There is no possibility of the trial concluding in near future. As such the petitioner may be released on bail.

Learned advocate for the State submits that the truck was being escorted by the petitioner who was driving the scorpio vehicle.

Be that as it may, there are question of facts and the trial has already commenced. Considering the quantum of seizure, at this stage I am not inclined to release the petitioner on bail.

Consequently, CRM (NDPS) 1097 of 2025 is dismissed. However, State is directed to complete at least seven witnesses by 15th of April, 2026.

Petitioner would be at liberty to approach this Court, in case the directions given above are violated by the prosecution. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
