Mr. Tarak Nath Halder, learned advocate appears on behalf of the opposite party and submits that the matrimonial suit being Matrimonial Suit No. 1529 of 2019 sought to be withdrawn and transferred by the present application under Section 24 of the Code of Civil Procedure which has already been decreed on February 24, rendering the present application infructuous.

He files photocopy of the order no. 12 dated February 24, 2021 passed in the matrimonial suit being Matrimonial Suit No. 1529 of 2019 by the learned Additional District Judge Fast Track 3rd Court Barackpore, District 24-Parganas (North) which is taken on record.

In view of such development of the matter during the pendency of the matter the application has become infructuous.

C.O. 3405 of 2019 is dismissed accordingly without any order as to costs.
