Sharique Afzol Mohammad Irfan .....For the Petitioner Mr. Gourav Das .....For the State The petitioners allege that though several complaints were lodged by the petitioners but the police authorities have not taken any step excepting registration of FIRs.
Mr. Das, learned advocate appearing for the State files a report of the Inspector-in-charge, Ramnagar Police Station dated 25th September, 2024 which is taken on record.
It appears from the said report that pursuant to the complaint lodged by the petitioners on February 9, 2024, an FIR was registered being Ramnagar P. S. Case No. 29/2024 dated 9th February, 2024. It has been further stated in the said report that during investigation the concerned Investigating Officer recorded the statement from available witnesses. A forensic expert visited the crime scene, collected evidence and sent it to the Forensic Science Laboratory for examination. The report further states that the 4th and 5th respondents submitted before the learned court on July 23, 2024 and the investigation is in progress. With regard to another written complaint of the petitioner no.4, Ramnagar PS Case No. 74/2024 dated 7th April, 2024 has been registered and after completion of investigation charge sheet Vide Ramnagar PS charge
sheet no. 80/24 dated 31.05.2024 has been filed before the concerned court at Diamond Harbour. In the said report it has been further stated that pursuant to another complaint of the petitioners dated 2nd of May, 2024, Ramnagar Police Station case no. 93 of 2024 dated 2nd May, 2024 has been registered under Sections 341/325/326/307/354/506/34 of the Indian Penal Code and Section 8 of the Protection of Children form Sexual Offences Act, 2012. In connection with the said case, the respondent nos.4, 5 and 6 surrendered before the learned jurisdictional court on 17th August, 2024 and the respondent no.3 surrendered on 3rd September, 2024 and they were granted bail by the learned Additional District Magistrate, Special Court, Diamond Harbour.
It further appears from the said report that charge sheet in connection with the said case has already been submitted vide Ramnagar PS charge sheet No. 147/24 dated 24th September, 2024. The report further states that on written complaint lodged by the petitioners Ramnagar Police Station 108 dated 22nd May, 2024 has been registered and investigation is in progress.
Therefore, it appears that the police authorities have taken steps pursuant to the complaints lodged by the petitioners. In respect of 3 cases investigation is in progress.
The concerned Investigating Officer is directed to conclude the investigation expeditiously. In the event, the petitioners are not satisfied with the progress of the investigation, it will be open to the petitioners to approach the concerned court for appropriate reliefs in accordance with law.
With the above observation and direction, the writ petition stands disposed.
There shall be no order as to costs.
