The subject-matter of the case relates to a dispute arising out of an agreement.

The learned Additional Government Pleader, in his report, draws the attention of the court that there was non-compliance in respect of the

agreement executed between the parties and also non-payment of the amount by the private respondent(s) in terms of the agreement.

The application reveals that the petitioner approached the learned Executive Magistrate both under Section 126 and under Section 163(2) of the BNSS.

I have considered the issues of dispute which is to be adjudicated by the learned Civil Court.

However, as the learned Executive Magistrate has already passed the order on 07th of August, 2024, the Officer-incharge of Chanditala Police Station would maintain a strict vigil at the locale and ensure that no breach of peace and tranquility takes place.

With the aforesaid observations, WPA 21181 of 2024 is disposed of.
