The dispute in the present case appears to center around the fruits of the wakf land specifically mangoes.

The petitioners have challenged an order passed by the concerned SDO dated 19th July, 2022 on the ground that the order contains reasons and was not supported by the facts but essentially for the reasons that the fruits of the trees on the land (in a literal sense) have been sold by the SDO and the petitioners have been given only half of the sale proceeds.

Although this Court is inclined to dismiss the writ petition for lack of a credible cause of

action, the suggestion made on behalf of the State respondents is accepted.

WPA 20936 of 2022 is disposed of with a direction on the respondent no. 2 being the District Magistrate, Malda to consider and dispose of the representation made by the petitioners on 26th July, 2022 within a period of three weeks from today upon hearing all the interested parties including the petitioners. A copy of the decision shall be made available to the petitioners within four weeks from the date on which such decision is taken.

Urgent photostat certified copy of this order, if applied for, be given to the parties on usual undertakings.
