In the writ petition the order of the grievance committed dated 6th December, 2021 has been questioned.

On perusal of the said order dated 6th December, 2021 it appears that though petitioner did not upload his Graduation and B.Ed marksheets on the website of the Commission in connection with petitioner's participation in 1st SLST 2016 (Upper Primary) but the grievance committee permitted the petitioner to upload those documents belatedly in order to treat the petitioner as trained candidate and take into consideration the Graduate marksheet as well as B.Ed marksheet of the petitioner.

It further appears that on taking note of the

performance of the petitioner in Graduation as well as in B.Ed examination the total marks which was awarded to the petitioner was 66.1111 as recorded by the grievance committee in the said order dated 6th December, 2021 where as cut off marks fixed under the category of the petitioner was 73.8667. The learned advocate for the petitioner made an attempt to persuade this Court to direct the Commission to apprise the marks obtained by the last candidate who was allowed to participate in the personality test. But in view of failure on the part of the petitioner to make out a case that who are other candidates being allowed to participate in personally test who secured marks less than the cut off marks as indicated in the impugned order dated 6th December, 2021, this Court is not inclined to pass further order directing the Commission to disclose further details.

It is also submitted on behalf of the petitioner that though leave was granted by a coordinate Bench vide order dated 22nd April, 2024 to file supplementary affidavit but the same has not been filed today though affirmed since petitioner has not been able to state the names and particulars of the candidates who have been allowed to participate in personality test in spite of

obtaining marks less than the cut off marks.

In view of aforesaid situation no relief can be granted to the petitioner.

Accordingly, the writ petition stands dismissed.

There shall be no order as to costs.

Urgent photostat certified copy of this order, if applied for, be given to the learned Advocates for the parties on the usual undertakings.
