IN THE HIGH COURT AT CALCUTTA

CIVIL APPELLATE JURISDICTION APPELLATE SIDE WPA 21912 of 2017 Md. Faridul Haque & Ors.

Vs.

The State of West Bengal & Ors.

Mr. Ibrahim Shaikh ...for the petitioners Heard learned advocate appearing for the petitioners.

There is inordinate delay in filing this writ petition without any explanation. It appears from the record that the petitioners had filed another writ petition being No. WP No. 5189 (W) of 2001 for similar relief of getting compensation of the land in question, which was disposed of by this court on 11th June, 2001 by passing certain orders. Thereafter, according to the petitioners have made several representations and last of such representations of the petitioners was made on 24th September, 2012 through their learned advocate as appears at page 31 of the writ petition and petitioners filed the present writ petition in the year 2017 but did not pursue. There is no explanation at all for the delay between the period 2001 to 2017 apart from the

fact that they did not even take any initiative for disposal of the matter.

Considering the facts, the writ petition WPA 21912 of 2017 is dismissed on the ground of inordinate delay lacking any explanation.
