02.09.2024 A-52 Court No.29 TN (Allowed) CRM (A) 3018 of 2024 In Re:- An application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 filed in connection with Chanchal Police Station Case No.709 of 2024 dated 08.07.2024 under Sections 110/115(2)/69/74/3(5) of the BNS, 2023.

1. Heard the learned counsel for the parties.

2. The learned counsel for the petitioner submits that during pendency of the matter, the marriage had taken place between the petitioner and the de facto complainant.

3. The learned counsel for the de facto complainant admits that the petitioner and the de facto complainant have married in the meantime and the marriage certificate dated 20.08.2024 is produced in court.

4. In view of the aforesaid circumstances, we are of the view that custodial interrogation of the petitioner is not necessary.

5. Accordingly, we direct that in the event of arrest, the petitioner, namely, Asraful shall be released on bail upon furnishing a bond of Rs.2,000/-, with one surety, to the satisfaction of the arresting officer and also subject to the Signed By :

conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973, corresponding to Section 482(2) of the BNSS, 2023.

6. The petitioner shall meet the Investigating Officer as and when required.

7. Accordingly, the application for anticipatory bail is disposed of.

8. The marriage certificate is kept on record.
