Heard learned counsels for the parties.

The 1st petitioner is a holder of permit in respect of vehicle bearing registration no. WB 4E/9133 in the route Borakar to Durgapur. The 1st petitioner intends to transfer the permit in favour of the 2nd petitioner for which both the petitioners submitted a joint application before the concerned authority on 4th April, 2017. The permit was valid upto 22nd April, 2017 for which the 1st petitioner submitted a separate application before the authority for renewal of the permit.

Learned counsel for the petitioners submits that though the petitioners were called for a hearing with regard to both the applications on 29th May, 2020 and attended the said hearing, no further communication was made to them as to whether an order was passed in this connection.

The petitioners seek a direction upon the authority to communicate the order, if any, passed by the authority in connection with their applications.

Leaned counsel for the respondents submits that the 2nd respondent be directed to take necessary steps in accordance with law.

In view of the above, the writ petition is disposed of directing the 2nd respondent to consider and dispose of the applications submitted by the petitioners for transfer as well as the renewal of the permit issued in favour of the 1st petitioner, if not already disposed of and communicate the decision taken by the authority to the petitioners within one month from the date of communication of this order.

With the above observations and directions the writ petition being WPA 20586 of 2023 is disposed of. However, there shall be no order as to costs. Since no affidavit is invited, the allegations contained in the petition are deemed not to be admitted. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
