Petitioner is directed to serve a copy of the revisional application upon Mr. Pravas Bhattacharya, learned advocate who ordinarily appears on behalf of the State. His appointment may be regularized by the concerned Authorities in due course. Learned advocate for the petitioner submits that the petitioners were taken into custody since 14th August, 2021 and since then they are in detention for more than two years but till date charge has not been framed. The prosecution in order to prove its case relied upon 10 witnesses, but till date not a single witness has been examined. It has been informed that the next date fixed by the learned trial court on 23rd November, 2023. Accordingly, the learned trial court is directed that in case no witness turns up on the date so fixed, the learned trial court would inform the Superintendent of Police of the concerned District and ensure regarding the availability of the witnesses on the date so fixed. The learned trial court would fix a schedule consisting of
three dates and such schedule be fixed once in every forty five days so that the trial of the case can be taken to its logical conclusion within a reasonable period of time.
No unnecessary adjournments should be granted to either of the parties.
The Public Prosecutor appearing in the case would produce the materials, documents and exhibits on the dates fixed for examination of the witnesses concerned. All efforts be taken by the stake-holders to cooperate with the trial court so that the trial is concluded within a reasonable period of time. With the aforesaid observations, the present revisional application being CRR 3188 of 2023 is disposed of. Pending applications, if any, are consequently disposed of.
