The petitioners allege that the private respondents are obstructing the public road in front of the petitioners' private premises.

Objection was raised before the Panchayat authority in August, 2023. The same is yet to be disposed of.

Without entering into the merit of the claim of the petitioners, as it appears that a representation is pending consideration at the end of the Gram Panchayat, accordingly, the Maheshpur Gram

Panchayat, Uluberia Block - I is directed to consider the representation filed by the petitioners strictly in accordance with the law after giving a reasonable opportunity of hearing to all the necessary parties. A spot inspection shall be conducted upon prior notice to all the authorities to ascertain as to whether any obstruction has been caused over the public land. In the event, it appears that the public land has been obstructed, then necessary steps shall be taken to deal with the same in accordance with the law. Steps shall be taken in the matter at the earliest but positively within a period of eight weeks from the date of communication of this order.

A reasoned order shall be passed and communicated to all the parties immediately thereafter. Learned advocate for the petitioners is directed to forward a copy of the representation dated 8th August, 2023 to the Panchayat at the time of communicating the order of the Court.

The writ petition stands disposed of.

Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
