The writ application has been preferred praying for direction upon the respondents to reconsider the candidature of both the petitioner and the private respondent no. 11 afresh by an independent agency from the office of the Directorate, DDP & S, Kolkata and select the best candidate and issue license in his favour.

On hearing the learned counsels for the parties and on perusal of the materials on record, it appears that the petitioner being aggrieved, on his licence being cancelled has made a representation on 4th August, 2025 before the authorities praying for necessary relief.

Learned counsel for the State objects to the case as made out by the petitioner and submits that as on the date of application, the petitioner did not have a ready go-down which is a mandatory condition in the vacancy notice and accordingly the respondent authorities have lawfully rejected his candidature. The

petitioner submits that he was medically unable to appear for the enquiry and further stressed upon the point that his godown was ready on the date of application which is totally denied by the State. 4.

Considering the submissions of both the parties, the writ application is disposed of with the direction that the respondent no. 5 shall dispose of the petitioner's representation dated 4th August, 2025, on hearing the parties and dispose of the same in accordance with law by passing a reasoned order within 60 days from the date of communication of this order.
