The report dated 17th September, 2024 filed by the District Inspector of Schools (SE), Paschim Medinipur is also taken on record.
On perusal of the report of the concerned District Inspector of Schools (SE) it appears that Rs.5,17,076/- was paid to the petitioner on compliance of necessary formalities on 6th September, 2024 in presence of the petitioner and the respondent no.6 but Rs.52,718/- could not be paid which was payable to him.
Mr. Ali, learned advocate representing the State respondent submits that if necessary direction is given upon the Assistant Inspector of Schools, Mednipur Sadar Sub-Division, in that event on taking necessary steps rest amount i.e. Rs.52,718/- shall be paid to the petitioner. Taking note of the submission made on behalf of the State respondent, Assistant Inspector of Schools, Medinipur Sadar Sub-Division is directed to release Rs.52,718/- to the petitioner, which is found payable by the concerned District Inspector of Schools (SE), Paschim Medinipur by four weeks from the date of communication of this order without insisting on submission of TR Forms. Assistant Inspector of Schools, Medinipur Sadar Sub-Division is not made party.
Learned advocate for the petitioner is granted leave to amend the cause title of the writ petition and add Assistant Inspector of Schools, Medinipur Sadar Sub-Division as additional respondent in course of the day. However, service of notice upon the additional respondent stands dispensed with since State respondent is represented by the learned advocate. Petitioner prays for payment of interest due to delayed payment of Provident Fund dues.
weeks from date for claiming interest due to delay occurred in releasing the Provident Fund. If such representation is made within the aforesaid time, the District Inspector of Schools (SE), Paschim Medinipur, being the respondent no.3, is directed to consider the said representation and pass order within four weeks thereafter.
In view of the aforesaid directions, the writ petition stands disposed of.
