1. This appeal is preferred against judgment and order of conviction dated 21.12.2006 passed by the Judicial Magistrate, 6th court, Paschim Medinipur in connection with C.R. Case No. 292/04, corresponding to T.R. Case No. 282/04, acquitting accused person of the charges under Section 138 of Negotiable Instrument Act.

2. Learned Advocate for the appellant has filed a written instruction from the appellant seeking permission to withdraw the instant criminal appeal. The prayer is allowed.

3. Accordingly, the instant criminal appeal is dismissed as withdrawn.

4. Lower court records along with a copy of this judgment be sent down at once to the Learned Trial Court for necessary action.

5. Photostat certified copy of this order, if applied for, be given to the parties on priority basis on compliance of all formalities. (Ananya Bandyopadhyay, J.)
