Mr. Debasish Chakraborty ... for the State - Respondent(s) The petitioner is aggrieved by the action of the police authorities in connection with Howrah PS Case No. 29 of 2025 dated 24.01.2025. The said case is presently being investigated by the Directorate of Economic Offences, West Bengal.

The petitioner complains that he has been served with notices under Section 160 of the Cr.P.C. and under Section 179 of the BNSS. He has complied with the same but no endorsement/acknowledgement has been given by the police authorities.

The petitioner further states that he is not in a position to assess whether he has been called as an accused or as a witness.

However, learned advocate for the State, on the other hand, submits that till date the petitioner has been called as a witness but no materials, till date, are available to classify him as an accused.

Having considered the submissions advanced by the parties, I am of the view that since the case is an ongoing investigation, at this stage, it would not be fit and proper to further disclose the facts at this stage of the investigation of the case.

However, if the petitioner apprehends of any act and actions of the police authorities, he would exhaust remedies available under the law.

With the aforesaid observations, WPA 20529 of 2025 is disposed of.
