Petitioner assails the order dated 3rd August, 2022 passed in Act VIII case No. 20/2022 (R No. 20- of 2022) pending before the learned District Judge, Paschim Medinipur, alleging that no interim visitation right of petitioner/father has been granted by the Court below. In the impugned order there is nothing mentioned regarding denial of the interim visitation right by the Court below. The Act VIII proceeding was admittedly filed on 5th of May, 2022. On the stipulated date, i.e., on 3rd August, 2022, petitioner/father deposited deficit Court fees and complete requisites to ensure service. There is no specific order in denial of interim visitation right of the petitioner/father. There is nothing to believe that such visitation right was denied by the Court below.

The revisional application is thus disposed of giving liberty to the petitioner to file an application for pre-ponment seeking interim visitation right of the petitioner/father in respect of his child in the concerned Act VIII proceeding, and if any such

application is filed within three days from hence, the same shall be addressed to by the Court below in accordance with law.

Petitioner is directed to make communication of this order to the learned court below as well as to the learned advocate appearing in the court below for the opposite party and the opposite party.

With this observation and direction, the revisional application stands disposed of.

Urgent photostat certified copy of the order, if applied for, be given to the parties on usual undertakings.
