Mr. Aneek Pandit Mr. Debapriya Ghosh Ms. Tanistha Jain ....for the petitioner Mr. Shiv Mangal Singh .... for the Bank The petitioner prays for a direction upon the respondent no. 2 to register the Sale Certificate, and to execute and register the Deed of Conveyance in respect of the property forming the subject matter of the present writ petition.
The petitioner participated in an auction process and, upon emerging as the successful bidder and completing all necessary formalities, the sale of a piece of land measuring 1 Cottah 7 Chittak 28 Sq. ft., located at 9/3B, Gopal Nagar Road, Kolkata Municipal Ward No. 74, Kolkata 700 027, was confirmed in his favour. The Sale Certificate, which appears on page 20 of this writ petition under Section 9(6) of the Security Interest (Enforcement) Rules, 2002, was also issued in his favour. However, the concerned Bank has not registered the Sale Certificate despite several requests made by the
petitioner. This inaction has compelled the petitioner to file this writ petition.
Mr. Singh, learned advocate representing the Bank, submits that due to the ongoing process of the merger and/or amalgamation of Allahabad Bank with Indian Bank, the registration of the Sale Certificate could not be completed. He further submits that now, with the merger and/or amalgamation having been completed, there is no hindrance to proceeding with the registration of the Sale Certificate.
In view of the submissions made on behalf of the Bank, the writ petition is disposed of with a direction to the Bank to fix a date for the registration of the Sale Certificate in consultation with the petitioner, and to complete the registration process in accordance with the law as expeditiously as possible.
The writ petition is, thus, disposed of.
There shall be no order as to costs.
