Petitioner has approached this Court being aggrieved that the circumstances created in and around the Restaurant-cum-Bar of the petitioner is hindering from carrying his business peacefully. To that effect, a civil suit was filed against the private respondent nos. 4 to 6. There are ad interim orders passed by the civil court also, but in spite of the same, petitioner is unable to carry on his business and even after informing the police authorities, no steps are being taken.
State has submitted a report which reflects that there are enclosures so far as representation made by the villagers are concerned. However, police claims that the petitioner is in possession
and police authorities did not find that there has been any violation of law and order.
In view of the aforesaid stand taken by the police authorities and as the petitioner claims that he has been running the business after obtaining due licence from the appropriate authorities, I direct the Additional S.P./SDPO in-charge of Deganga Police Station henceforth would deal with any inconvenience faced by the petitioner while carrying on his trade or business.
With the aforesaid observations, the writ petition being WPA 20789 of 2025 is disposed of. There will be no order as to costs.
All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
