Petitioner has filed this writ petition seeking remedy against the bank concerned by allowing it to settle the dispute regarding loan in question which admittedly she has not paid.

It appears from record and the submission of the respondent bank that towards recovery of the loan in question, property has already been sold out to a third party and as such right to a third party has already been accrued and who is not party to the writ petition.

Considering the facts and circumstances of this case and discussion made above, I am of the view that there is no merit in this writ petition. Accordingly the same is dismissed.
