The only grievance of the petitioner is that the Estate Officer is proceeding with the eviction case, keeping the maintainability application pending.

The learned Advocate for the opposite party no.1 is present before this Court. The opposite parties are granted leave to file their objection to the maintainability application filed by the petitioner within two weeks from date. Rejoinder to the same be filed within a week thereafter.

The maintainability application shall be disposed of by the Estate Officer within a month from completion of the pleadings, by framing a preliminary issue.

Both the parties are directed to request the Estate Officer to fix a date for hearing of the maintainability issue.

Accordingly, the revisional application is disposed of.

6.

There shall be no order as to costs.
