The petitioner is an Assistant Teacher in the subject Mathematics at Ultadanga United Girls High School, Kolkata.

The prayer of the petitioner for higher scale of pay on enhancement of her qualification in the relevant subject was allowed vide order dated April 16, 2021 passed in WPA 21420 of 2017 whereby the concerned authorities were directed to fix higher scale of pay for the petitioner from the date following the last date of final examination of the Post Graduate course.

The petitioner is complaining that in spite of the said direction, the higher scale of pay has not been fixed to her.

Chattopadhyay, learned Additional Government Pleader submits that though an appeal on the selfsame issue is pending before the Hon'ble Division Bench but a direction fixing

such higher scale of pay for the petitioner since has already been passed, to comply with the said direction, the authorities shall take necessary steps.

The respondent no.4 therefore, is directed to fix the higher scale of pay for the petitioner within a period of ten weeks from date and shall also disburse the arrear salary accrued to her on fixation of said scale of pay.

WPA 20625 of 2023 is disposed of with the above terms without any order as to costs.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
