Petitioner was Headmaster of a Government aided school who retired on superannuation on 30th June, 2020 and Pension Payment Order was issued on 24th February, 2021 releasing retiral dues including pension. It is submitted by learned advocate representing the petitioner that due to sanction of twenty years service benefits after completing twenty years of approved service on 1st January, 2005 petitioner is entitled to get arrear dues for the period from April, 2008 to October, 2019. It is also submitted that at the time of calculating retiral dues State authorities found certain amount was drawn in excess by the petitioner which petitioner refunded before settling

his pension case. Petitioner prays for payment of arrear dues relating to sanction of twenty years service benefits for the period from April, 2008 to October, 2019. In support of such contention, reliance is placed on letter dated 17th August, 2023/ 8th September, 2023 issued by Headmaster and Secretary of Mitra Institution (Main), Kolkata which was addressed to the District Inspector of Schools (SE), Kolkata being respondent no. 3. 3.

State respondents are represented by Mr.

Vaisya, learned Additional Government Pleader, who submits that as aforesaid school authority forwarded the issue to respondent no. 3 it needs consideration by said respondent.

Having considered the respective submissions made on behalf of the parties, writ petition stands disposed of directing respondent no. 3 to take a decision relating to entitlement of the petitioner to arrear dues for the period from April, 2008 to October, 2019 in connection with twenty years service benefits by eight weeks from date of communication of this order after granting opportunity of hearing to the petitioner and said school authority or their representatives.

Respondent no. 3 shall pass a reasoned order which shall be communicated to the petitioner by fortnight thereafter.

There shall be no order as to costs.

Urgent photostat certified copy of this order, if applied for, be given to the parties on usual undertaking.
