It is submitted by the learned counsel appearing on behalf of the petitioners that the petitioners have preferred an appeal under Section 10(4) of the West Bengal Highways Act, 1964 (in short, "the Act of 1964") against the order passed under Section 10(3) of the Act of 1964. Petitioners complain that the authorities have proceeded to demolish the structure of the petitioners in the plot in question pending disposal of the appeal under Section 10(4) of the Act of 1964.

Learned counsels appearing on behalf of the respondents seek a day's accommodation to make their respective submission.

Let this matter appear under the same heading on September 16, 2022 (fairly at the top).

In the meantime no coercive action be taken by the State-respondents in respect of the plot in question. (Suvra Ghosh,J)
