1. Learned counsel appearing for the petitioner submits as follows. There are case and counter case between the private parties. In fact, there is an earlier case started by the petitioner against the de-facto complainant alleging rape.

2. Learned counsel appearing for the State opposes the prayer for anticipatory bail and refers to the materials available in the case diary and submits that the petitioner, as a bar dancer, came into contact with the defacto complainant. She had been allegedly extorting money with a threat that she would lodge a false case of rape. It was further alleged that when the de-facto complainant refused to pay further money, the earlier case was lodged. The present case is about the alleged

extortion committed by the lady. The lady did not cooperate with the investigation.

3. Considering the materials available in the case diary and the fact that there are case and counter case, I do not think that custodial interrogation of the petitioner is required in this case and I am inclined to grant anticipatory bail to the petitioner.

4. In the event of arrest, the petitioner shall be released on bail upon furnishing a bond of Rs.10,000/- each with two sureties of like amount each, one of whom must be local, to the satisfaction of the Arresting Officer and also be subject to further conditions that the petitioner shall cooperate with the investigation and shall not threaten or intimidate the witnesses.

5. Accordingly, the application for anticipatory bail is allowed.

6. Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance with requisite formalities.
