It is submitted on behalf of the petitioner that the respondent Corporation is acting illegally and unlawfully in demolishing a portion of the subject premises.

The petitioner also complains of nonconsideration of a representation dated 26th August, 2025 by the Corporation.

Mr. Ghosh, Advocate appearing on behalf of the Corporation submits that there has been no illegality whatsoever and the actions of the Corporation are fully justified.

Without entering into the merits of the case, WPA 20608 of 2025 stands disposed of by directing the respondent No. 3 to consider and dispose of the representation filed by the petitioner dated 26th August, 2025 within a week from the date of communication of this order.

The petitioner also relies on a sanctioned plan to justify the proposed construction. The Executive Engineer i.e. the respondent No. 3 will consider the subject sanctioned plan in accordance with law. It is made clear that there has been adjudication on the merits of the case and all issues are left open to be decided by the Executive Engineer without being influenced by any observation on the merits.
