The petitioner alleges that the police authorities have not taken any steps pursuant to the complaint lodged by the petitioner through his learned Advocate's letter dated July 24, 2024. The learned Advocate appearing for the petitioner submits that the private respondents have encroached upon the property of the petitioner and have gathered sand, bricks, cement, rods etc. The learned Advocate further submits that the private respondents are making construction on the property of the petitioner.

The learned Advocate appearing for the State submits that upon enquiry it transpires that no construction activity is going on.

In case, the private respondents have encroached upon the property of the petitioner, the petitioner has to approach the proper forum for appropriate reliefs. However, it is the duty of the police authorities to maintain peace and tranquility at the locality.

The writ petition is disposed of by directing the Inspector-in-Charge. Joynagar Police Station, to see that no breach of peace takes place at the locale. There shall, however, be no order as to costs. Urgent photostat certified copy of this order, if applied for, be made available to the parties upon compliance of necessary formalities.
