Mr. Chakraborty, learned counsel submits on the basis of relevant correspondences, that the security deposit amount of the petitioner to the tune of Rs.67,88,982/- has already been refunded to the writ petitioner on 5th September, 2024.
Therefore, Mr. Chakraborty further submits, that the writ petition has now become infructuous.
Let the documents as relied on by the respondents be taken on record, pursuant to the same and on the basis of the submissions made by Mr. Chakraborty, it can be held that the writ petition has now become infructuous. The security deposit amount has already been refunded to the petitioner.
In that event, there remains no point for further adjudication of the case.
Mr. Chakraborty, learned counsel has specifically referred to the letter of the writ petitioner dated 27th August, 2024 ascertaining therein regarding receipt of the security deposit amount and also that the petitioner
would not be filing any further proceeding on the said claim. Noted and the following is directed:- The writ petition is dismissed being infructuous. (Rai Chattopadhyay, J.)
