1. In view of the fact that the appellant cannot be treated as a 'victim' under Section 2(wa) of the Code of Criminal Procedure and also the appellant cannot be considered to be a victim in terms of the proviso to Section 372 Cr.P.C., this application is dismissed as misconceived.

2. However, this shall not stand in the way of the appellant to take steps in accordance with law.

3. The original certified copy shall be returned to the learned advocate for the applicant after retaining a photocopy of the same.
