Learned advocate appearing for the petitioner submits that the learned trial court being the learned Judicial Magistrate, 2nd Court, Barrackpore is fixing the dates for execution case and the main case in such a manner that the petitioner is seriously prejudiced. According to the learned advocate that after receiving the amount, the wife is not ready to give evidence before the court. It has been informed that the next date for the execution case (M.Ex. Case No. 187 of 2022) is fixed on 04.09.2023 and the main case (M. Case No. 597 of 2021) is fixed on 16.01.2024.

Having regard to the contentions advanced by the learned advocate appearing for the petitioner, I direct that on 04.09.2023, the learned Judicial Magistrate, 2nd Court, Barrackpore would fix, if required at all, the date for M.Ex. Case No. 187 of 2022 on 16.01.2024. Thereafter the learned trial court would fix M.Ex. Case No. 187 of 2022 and M. Case No. 597 of 2021 on one and the same date.

With the aforesaid observations, the revisional application being CRR 3204 of 2023 is disposed of. Pending connected application, if any, is consequently disposed of.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
