.24 Sl-51 Ct.33 (S.R.) The instant criminal revisional application is pending since 2011 and as such, required to be disposed of. None appears for the parties.

The instant revisional application has been filed for quashing of a proceeding being G.R. No.616 of 2011 arising out of Rampurhat P.S. Case No.143/2011 dated 29.08.2011 under Section 379 of the Indian Penal Code pending before the Court of the learned Additional Chief Judicial Magistrate, Rampurhat, Birbhum. The complaint was filed before the inspector-in-charge of Rampurhat Police Station, inter alia, stating that the petitioner was conducted the quarry of mines without a permit for mining lease or temporary licence was required under the statutory provisions and committed a theft of 4,38,530 cft. (excluding overburden of black stone). Investigation was completed and charge-sheet was filed. The materials on record as well as the case diary alleges the commission of cognizable offence and as such, this Court is not inclined to quash the proceeding as aforesaid. Under such circumstances, the instant revisional application is dismissed.

Copy of the order be sent to the trial court for immediate compliance.
