2021-07-26Hon'Ble Justice Ravi Krishan Kapur2 pages

July 26, 2021 ARDR (23) WPA 19083 of 2019 Hafijul Islam Mia Vs.

The Union of India & Ors.

Mr. Sarwar Jahan, ...for the petitioner.

Mr. Mrinal Kanti Mukherjee, ...for the respondent nos. 1,3 and4.

Mr. Susovan Sengupta, Mr. Manas Kumar Sadhu, ...for the State.

The grievance of the petitioner is that the representation made to the respondent no.6 complaining of irregularities and illegalities committed by the respondents has not been considered nor disposed of by the respondent no.6.

The respondents are represented and submit that notwithstanding service of a notice for hearing by the respondent no.6, the petitioner had deliberately and intentionally chosen not to appear.

In view of the submissions made on behalf of the parties, WPA 19083 of 2019 is disposed of by directing the respondent no. 6 to consider and dispose of the representation of the petitioner within a period of eight weeks from the date of communication of this order after giving a right of hearing to all the affected parties. It is made clear that I have not gone into the merits of the case and all issues are left open to be decided by the respondent no.6 without being

influenced by any observation made in this order and in accordance with law.
