Petitioner is in custody for 63 days. He submits that the police report has not been filed. Hence, he prayed for statutory bail. Learned Magistrate postponed the hearing in view of the present application pending before this court. Lawyer for the State does not dispute the submission that police report has not been filed as yet.

Under such circumstances, we dispose of the application by giving liberty to the petitioner to pursue his prayer for statutory bail in accordance with law.

Accordingly, the application is disposed of.
