Mr. Shibjit Mitra, learned advocate appears for the petitioner.

Mr. Deb Narayn Banerjee, learned State advocate appears for respondent Nos. 1, 5 and 6. The Pradhan is not represented, despite notice. The law presumes the respondent No. 2 does not want to defend this writ petition.

The petitioner referring to the statutory application claiming sanction plan, annexure P-3 at page 17 to the writ petition submits that, the Pradhan has not yet been considered the same and the same is lying pending.

In view of the above, the respondent No. 2, the Pradhan of the concerned Gram Panchayat is directed to dispose of the said application being annexure P-3 at page 17 to the writ petition strictly in accordance

with law. If necessary, the Pradhan shall call upon the petitioner for assistance and in that event, the petitioner shall render all necessary assistance to the Pradhan.

The entire exercise as directed above shall be and must be carried out and completed by the Pradhan positively within a period of four weeks from the communication of this order.

Since affidavits are not called for, the allegations made in this writ petition are deemed not to have been admitted by the respondents.

On the above terms, this writ petition W.P.A 20654 of 2023 stands disposed of, without any order as to costs.

Urgent certified photo copy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
