1. On payment of costs of Rs.10,000/- within one week from date, the execution proceeding shall remain stayed and the appeal shall be heard and disposed of on merits.

2. We make it clear that in the event for a single default on the part of the appellant to appear before the first appellate court at the time of hearing of the appeal, it would be open for the first appellate court to pass appropriate order in the said proceeding.

3. There shall be unconditional stay of execution proceeding for a period of ten days. In default execution proceeding shall revive.
