Mr. De, learned advocate appearing for the petitioner submits that the learned Magistrate by its orders dated 23.02.2010 and 14.07.2010 refused to take cognizance of the offence under Section 307 of the Indian Penal Code and rejected the prayer of the petitioner/ de facto complainant for further investigation of the case. The revisional application was listed on 25th August, 2010. Although service was effected but today when the matter has been called on, none represented the State. Accordingly, Mr. Anwar Hossain, learned advocate who ordinarily appears on behalf of the State is directed to represent the State. His appointment may be regularized by the concerned Authorities in due course.
In view of the passage of time which has elapsed and no information being furnished to this court regarding the present stage of the proceedings before the learned Magistrate, I am of the opinion that the revisional application may be disposed of with the direction that if the proceedings are still pending at the appropriate stage, the petitioner/de facto complainant would be at liberty to agitate the points canvassed in this revisional application before the learned trial court.
Accordingly, the revisional application being CRR 2545 of 2010 is disposed of.
Pending applications, if any, are consequently disposed of. All concerned parties are to act in terms of a copy of this order duly downloaded from the official website of this court. [Tirthankar Ghosh, J]
